Terms & Conditions of sale

1. ORDERING, SHIPPING AND DELIVERY

a. All services supplied or goods purchased from us are subject to these terms and conditions.

b. You confirm that you are over 18 years old.

c. You may order Goods from the Web Site by submitting a completed order form.

d. Please note that all orders are subject to availability.

e. We aim to keep items in stock at all times, however there may be rare instances when the items are unavailable therefore it will not be possible to order any item that is not in stock.

f. All items in the Milk & Honey collections have been carefully selected to reach optimum standards of quality. Please be aware that whilst we take great care to describe all our products, some of the items are handmade or customized and so, are unique- therefore some of the colours and design may slightly vary.

g. What is the total price I will have to pay?

The delivery prices vary depending on the weight of your item/s. The delivery cost will be displayed to you when you select the Royal mail method you prefer.

h. How long will you take to dispatch my items?

If we receive your cleared payment before 5pm GMT we aim to process and dispatch your order the next working day. For orders placed after 5pm GMT they will be processed the following day.

i. How will my package be sent?

Your package will be sent in plain packaging marked for the addressee. We will dispatch your goods byia the Royal Mail service of your choice. Our name and contact details may be displayed on the outside of the packaging. For Customs declarations and as required by certain carriers a basic description of the contents maybe displayed on the outside in small wording.

j. Is my package insured against loss?

For UK delivery, only Special Delivery will provide compensation of up to £500. For worldwide delivery, only the Internationally Signed For will be sent with compensation up to £500.

k. Will I have to pay any Customs charges for goods delivered to an address outside the UK?

It is a legal requirement that we declare the full value of the goods on all packages sent outside the European Union and these specific EU destinations: Andorra, Canary Islands, Gibraltar, San Marino and Vatican City State. Shipments sent to these destinations may be subject to import duty, tax and customs clearance charges. Unfortunately we do not have any control over these charges. The addressee must pay for all additional charges.

l. The Company will confirm acceptance of your order by e-mail to the e-mail address you supply and the sending of this e-mail, whether or not the same is received by you, is confirmation of the details of the order and of the contract with us. Please make sure you provide us with the correct e mail address and ensure that your e mail is in full working order.

m. The Company shall not be liable for any problems caused by you supplying faulty information (such as the wrong email address or wrong delivery address) or due to your failure to make any particular specification.

n. No statements made in these terms or on this Web Site shall be deemed to affect the statutory rights of a consumer which cannot be restricted or excluded currently under the law.

o. Every effort is made to ensure that the information featured on the website is correct, in the case of errors being made we will endeavour to remedy, replace or refund goods as quickly as possible from the time of being made aware of the situation, we will not be held liable or responsible for any losses as set out in the limitations of liability section of these terms.

p. It is the responsibility of the customer to notify us immediately if there are any delivery problems or if the goods ordered are unfit for purpose, not as described on the Web Site or not of satisfactory quality.

q. All products and services and postage and packaging must be paid for in full prior to the dispatch of goods ordered unless agreed in writing. Once an order has been placed and processed it may not be cancelled without due cause.

2. PRICE AND PAYMENT TERMS

a. The Price of the Goods shall be the price quoted on the Web Site at the time your order is accepted. We try to ensure that all details including prices are displayed accurately and are to date. Obviously prices may vary from time to time so please make sure you check all the relevant details before you place an order with us as prices may have altered since you last visited our site.

b. You can pay for your items via the secure online payment system Protx using the following payment cards: Visa, Visa Delta/Debit, Visa Electron, Mastercard, UK Maestro, and Solo. We do not store any credit card details or other sensitive information at Milk & Honey. All transactions are processed by SAGEPAY, who use bank approved software and the highest level of encryption to ensure that your credit card details are kept secure at all times.

c. Payments can be accepted online using SAGEPAY. If you are paying online for goods with a total value in £ GBP sterling using another currency, your issuer will transfer the funds at the appropriate rate. Please refer to your issuer for full details.

d. We also accept payments via Paypal, in addition to the cards accepted by SAGEPAY. Please be aware occasionally there may be delays with receiving payments.

h. If you wish to send us any messages or make any changes to your order this can be done by emailing info@milkandhoneykids.co.uk using our contact us page. Please be sure to quote your unique order number, date of order, total amount due and your email address with all correspondence.

m. All prices are inclusive of VAT (value added tax).

o. These terms of sale are subject to change without notice and are correct at time of writing. Our items are available in a range of sizes. For more information on our sizes please see our Size Guide Chart.

3. CARING FOR YOUR ITEM

a. Always follow the manufacturer's instructions in connection with care and washing of your goods.

4. RETURNS

a. As you are buying Goods over the internet you may have rights under the Distance Selling Regulations which currently give you the legal right to cancel your order within seven (7) working days of receiving the Goods ordered. Please note that these regulations do NOT APPLY to certain items including but not limited to ANY BESPOKE ORDERS or certain goods which cannot be returned due to Health and Safety regulations.

b. All of our items are checked thoroughly before dispatch. However if you find an item to be faulty, please contact us either by email, info@milkandhoneykids.co.uk or letter within 7 days of delivery to advise us of the problem. We will give you a reference number that must be quoted with your returned item. You will also need to complete and enclose a returns form with your returns parcel.

c. We need to receive your item back within 14 days of your delivery date.

d. Once we have received the faulty item we may need to turn the item back to the manufacturer for inspection. Once we have confirmation that the product is faulty then we can arrange for a replacement or a refund. The decision as to whether an item is faulty is at the discretion of the company. Payments will be refunded within 30 days.

e. If the fault is not reported within a reasonable time, we reserve the right to refuse a full refund and offer pro rata compensation.

f. We reserve the right to occasionally vary the item slightly from its picture or description. Please be aware that different monitor resolution settings and the age of your monitor may affect the brightness and colour of the item picture.

g. If the item is not as described or shown in the picture or if you change your mind and you wish to return a product you will need to contact us requesting the cancellation of your goods and giving your reason. This must be done within 7 days of you receiving the goods and we must be advised in the form of an email, letter or fax. We will give you a reference number that must be quoted when you return the item. We need to receive your item back within 14 days of your delivery date.

h. All returns must be unworn, unmarked, in original packaging and containing all tags. The items must be free from smoke and other odours. Reasonable care of the goods must be taken whilst in your possession.

i. If these conditions are met we will be happy to exchange the item or issue a refund. We do not offer refunds on postage, except in cases of faulty goods. For refunds for orders returned that were ordered with free delivery, we reserve the right to make a charge for postage costs. For exchanges we reserve the right to charge additional postage.

j. We reserve the right to send the goods back to you if it is deemed these conditions have not been met. We reserve the right to charge you any additional postage. We reserve the right to charge an admin fee for goods that do not meet these conditions. Payments will be refunded within 30 days.

k. We cannot accept liability for any returns that are posted but not received. We are unable to cover the cost of any returns for cancelled items. If the cancelled goods fail to be returned, we will seek to claim full recovery of the value of the goods plus additional administration charges to cover the direct costs of recovery.
